All Medical & Beach Equipment Rental Agreement

Release of Liability, Equipment Responsibility, and Cancellation Policy

Please read carefully before signing. This agreement includes a release of liability and waiver of certain legal rights.

Definitions

Renter: The individual who will use the rented equipment.

Undersigned: The person signing this Agreement and accepting full legal and financial responsibility, whether or not that person will use the equipment.

If the Renter is a minor, has special needs, is medically vulnerable, or cannot legally consent, the Undersigned represents that they are the parent, legal guardian, caregiver, or authorized representative with authority to act for the Renter.

The Undersigned is responsible for payment, proper use, damage, loss, liability, and all other obligations under this Agreement.

1. Company and Equipment

On Call Hospitality, LLC d/b/a On Call Mobility rents mobility, medical, and beach-access equipment, including wheelchairs, beach wheelchairs, beach walkers, shower chairs, toilet risers, knee scooters, and related accessories (“Mobility Equipment”).

The Undersigned understands that use of Mobility Equipment involves inherent risks, including serious injury or death. All equipment is rented as is, without warranties, express or implied.

2. Equipment Condition and Responsibility

The Undersigned accepts full responsibility for the care, proper use, and timely return of all Mobility Equipment during the rental period.

The Undersigned is responsible for full retail replacement cost if any Mobility Equipment is lost, stolen, not returned, or returned damaged beyond normal wear and tear.

Only the Renter identified in this Agreement may use the Mobility Equipment unless On Call Mobility gives written approval otherwise.

3. Orientation and Safety (No Medical Instruction)

On Call Mobility provides equipment rental only and does not provide medical advice, diagnosis, therapy, training, supervision, or patient care.

For certain equipment, especially beach wheelchairs and related accessories, On Call Mobility may provide limited operating and safety information, including safe entry and exit procedures, adjustment of arms, headrests, and accessories, and use of provided tools.

Beach wheelchair use: Beach wheelchairs are designed for sand, packed dirt, grass, and similar non-paved surfaces. They are not intended for highways, paved roads, parking lots, or areas with sharp debris that may damage tires.

Users must enter and exit from the side by lifting the arm and exiting backward. Do not enter or exit from the front.

Reporting requirement: If any equipment appears unsafe, damaged, or not operating properly, the Renter or Undersigned must stop using it immediately and notify On Call Mobility during the rental period so it can be inspected, adjusted, repaired, or replaced.

Failure to report an issue during the rental period constitutes acceptance of the equipment’s condition and is not grounds for a refund, credit, or post-rental dispute.

4. Accessories

Some rentals may include accessories such as umbrellas, headrests, or adjustment tools at no extra charge. These items remain the property of On Call Mobility.

The Undersigned is responsible for the care and return of all accessories and may be charged for loss or damage.

5. Care, Cleaning, and Maintenance

The Undersigned agrees to use reasonable care in maintaining all rented equipment during the rental period.

For beach wheelchairs and equipment exposed to sand or salt, the Undersigned agrees to rinse off sand and debris when reasonably possible, pay particular attention to wheels, tires, bearings, and moving parts, and avoid sharp debris and unsuitable surfaces.

Failure to reasonably clean or care for the equipment resulting in excessive wear, damage, or repairs beyond normal use may result in additional charges.

Normal wear from proper use is expected. Damage caused by neglect, misuse, or failure to follow basic care instructions is the responsibility of the Undersigned.

6. Customer Pick-Up, Transport, and Relocation

If the Undersigned picks up, transports, moves, or relocates the Mobility Equipment, the Undersigned assumes full responsibility during loading, transport, unloading, and use.

Any damage caused by improper loading, securing, transport, or handling, including bent frames, structural damage, or missing components, is the responsibility of the Undersigned and may result in repair or replacement charges.

On Call Mobility is not responsible for damage once equipment is transported by the Undersigned or any third party acting on their behalf.

7. Assumption of Risk and Release of Liability

The Undersigned and the Renter acknowledge the risks associated with use of Mobility Equipment and voluntarily assume all such risks.

In consideration of the rental, the Undersigned agrees to release, defend, indemnify, and hold harmless On Call Hospitality, LLC d/b/a On Call Mobility and its owners, officers, directors, employees, agents, representatives, successors, and assigns (“Released Parties”) from any claim for injury, death, or property damage arising from the Renter’s use of the Mobility Equipment, including claims based on alleged negligence or alleged breach of warranty.

The Undersigned agrees not to sue any Released Party and to pay attorney fees and costs incurred in defending any claim brought by or on behalf of the Undersigned.

These obligations and releases apply whether or not the Undersigned personally uses the equipment.

8. Governing Law and Severability

This Agreement is governed by South Carolina law, and any claim arising from the use of the equipment must be brought in the appropriate state court in South Carolina.

If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full force and effect.

9. Reservation Fee, Cancellation, and Refund Policy

To reserve equipment and remove it from availability, part of the rental fee is treated as a non-refundable reservation fee.

Reservation fee: 25% of the rental fee only, excluding delivery charges and taxes, capped at $75.

Cancellations and refunds: More than 7 days before delivery: refund minus the reservation fee. 3–6 days before delivery: 50% refund of the rental fee. Within 72 hours, no-shows, or refusal of delivery: generally non-refundable.

This policy applies regardless of reason, including illness or emergencies. In special circumstances, the company may, in its discretion, offer a future rental credit.

Acknowledgment and Signature

I have carefully read and understand this Agreement. I understand that it is a release of liability and a legally binding contract.
